These Terms and Conditions govern the purchase and use of photographs and digital image licenses from Eriena Photography ("we", "us", "our"). By purchasing any image license from us you agree to be bound by these terms.
1. Copyright & Ownership
All photographs produced by Eriena Photography are the exclusive intellectual property of Eriena Photography and are protected by copyright law. The purchase of any image or license does not transfer copyright ownership to the buyer. All rights not expressly granted in a license below are reserved by Eriena Photography.
You may not sell, sub-license, transfer, or otherwise assign any rights granted to you under these Terms to any third party without our prior written consent.
2. Non-Exclusive Digital License — Low Resolution
A Low-Resolution Digital License grants you a non-exclusive, non-transferable right to use the supplied digital image in low-resolution form for personal use only.
Permitted uses include:
- Sharing on personal social media profiles (e.g. Facebook, Instagram, X / Twitter, TikTok)
- Display on personal non-commercial blogs or websites
- Use in personal digital communications (e.g. messaging apps, personal email)
- Saving as a personal screensaver or digital wallpaper
Not permitted under this license:
- Printing the image in any form (physical prints, merchandise, etc.)
- Any commercial use, including use on business social media accounts, advertising, or promotional material
- Altering, cropping, filtering, or manipulating the image in a way that misrepresents the original work
- Removing or obscuring any watermark or copyright notice
3. Non-Exclusive Digital License — High Resolution (Personal)
A High-Resolution Digital License (Personal) grants you a non-exclusive, non-transferable right to use the supplied high-resolution digital image for personal use only.
Permitted uses include:
- All permitted uses listed under the Low-Resolution Digital License above
- Printing the image an unlimited number of times for your own personal, non-commercial use (e.g. framed prints, photo books, greetings cards for personal gifting)
- Ordering prints or printed products through a professional print lab for personal use
Not permitted under this license:
- Any commercial use of the image, including use on business social media, advertising, sponsorship material, or resale of printed products
- Sub-licensing the image to any third party
- Altering, cropping, filtering, or manipulating the image in a way that misrepresents the original work
- Removing or obscuring any watermark or copyright notice
4. Non-Exclusive Commercial License — High Resolution
A High-Resolution Commercial License grants you a non-exclusive, non-transferable right to use the supplied high-resolution digital image for commercial purposes as described below.
Permitted uses include:
- All permitted uses listed under the High-Resolution Digital License (Personal) above
- Use in commercial advertising, marketing, and promotional material (digital and print)
- Publication in print media (e.g. magazines, newspapers, brochures, catalogues)
- Use on commercial websites, social media business accounts, and digital campaigns
- Use on branded merchandise intended for commercial sale
- Use in editorial content for publications and online media
Not permitted under this license:
- Transferring or sub-licensing the image to any third party
- Claiming copyright ownership of the image
- Altering, cropping, filtering, or manipulating the image in a way that misrepresents the original work or harms the reputation of Eriena Photography
- Removing or obscuring any watermark or copyright notice
- Use in any content that is unlawful, defamatory, obscene, or otherwise objectionable
5. Attribution
Wherever reasonably practical, we ask that you credit Eriena Photography when sharing or publishing licensed images. Attribution is required for all commercial uses. Suggested credit: "Photography © Eriena Photography".
6. General Prohibited Uses
Regardless of license type, the following are strictly prohibited:
- Using images in ways that are defamatory, misleading, or unlawful
- Using images as part of a trademark, logo, or other registered intellectual property
- Training, fine-tuning, or otherwise using images as data for artificial intelligence, machine learning, or automated image generation systems
- Offering the images (or derivative works) for download or resale on stock image platforms or similar services
7. Digital Purchases & Refunds
Because digital image files are delivered electronically and are accessible immediately after payment, all digital license purchases are final and non-refundable once the download link has been accessed or the file has been downloaded.

8. Breach & Enforcement
Any use of our images outside the scope of the license purchased constitutes copyright infringement. We reserve the right to pursue all available legal remedies, including seeking damages and injunctive relief, in such cases.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Scotland and the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
10. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. The current version will always be available at this page. Continued use of our website or purchase of any license after changes are published constitutes your acceptance of the updated terms.
